Common Questions
If my partner is asleep or passed out, can we still have sex?
No. If your partner is unconscious in any way, they cannot give consent to sexual activity. This is true even if they had agreed to it before falling asleep or passing out (you cannot pre-book consent).
My partner said we can have sex after the party, but then changed their mind; is this consent?
No, this is not consent. You cannot pre-book consent, and anyone is able to change their mind at any time.
A 15-year-old consented to having sex with a 50-year-old in exchange for a new phone; is this legal?
This is illegal. A 15-year-old is not legally able to consent to sexual activity regardless of the age of the other person.
A 25-year-old consented to having sex with a 50-year-old in exchange for a new phone; is this legal?
This is legal. However, expectations, boundaries and consent should be discussed between both parties.

You can send nudes if the other person consents to receiving them, and they are not a minor.
You can have nudes on your phone from someone that has shared their own image with you themselves. If you have received a nude of someone by another person, it is unlikely that the person has consented to having their photo shared. This is illegal. It is also illegal to share nudes you have received if that person has not consented to you sharing their nudes with others.
Will I get into trouble if I was underage-drinking and got raped?
No. Police take rape and sexual abuse very seriously, and that person has a right to report rape to police even if they had done something illegal (like underage drinking).
